Westchester County authorized the county executive to sign a lease with JPMorgan Chase for Hangar E-1 at Westchester County Airport in White Plains, N.Y., but the actual lease has been delayed by court action. Current leaseholder Avitat Westchester recently filed a temporary restraining order, asking the court to delay the lease, according to Avitat president Mike Dolphin. The court approved a 30-day delay and also required a 20-day advance notice of a lease signing, he said, which will allow the court time to rule on Avitat’s lawsuit against the county. If the court blocks the lease, he said, “We’ll be duking it out for a year.” Avitat Westchester filed a lawsuit claiming that the county violated the FBO’s 1st and 14th Amendment rights by reassigning the Hangar E-1 lease to JPMorgan Chase and not allowing Avitat to renew the lease. Dolphin said that Avitat would gladly pay the $1.2 million annual lease that JPMorgan has agreed to and that Avitat spent $100,000 on a proposal to refurbish the hangar as part of its renewal. JPMorgan Chase declined to comment on the issue, but the company does plan to house its two new Gulfstream G650s in the new hangar, according to news reports.
