The FAA has published Notice N8900.4 containing additional guidance on OpSpec A008 and A002, which NBAA and the National Air Transportation Association (NATA) have been advocating for some time. According to NATA, the new policy “clarifies several lingering industry concerns over pilot pay, fuel and insurance payments.” For example, the notice clears up a previous point of confusion by saying that certificate holders are not required to pay the pilot and it is possible for a pilot to remain employed by the aircraft owner. Additional guidance explains that while the aircraft used on Part 135 operations must be in the legal possession of the certificate holder, that certificate holder is not required to own the aircraft. Furthermore, NATA said, the new notice better explains the two-tiered operational control concept, whereby pilot and management functions are clearly differentiated. NBAA and NATA are urging operators to adopt the revised A008 by the end of this month.
