The Cargo Airline Association (CAA), representing air cargo carriers in the U.S., has sided with the FAA in a lawsuit brought against the agency by UPS pilots over its <a href="?q=aviation-news/2011-12-23/faa-issues-pilot-duty-rule-excludes-cargo-carriers#en">flight crew member duty and rest rule</a>, issued December 21. The CAA filed a motion Wednesday in the U.S. Court of Appeals for the D.C. Circuit to intervene on behalf of the FAA, the respondent in a petition for review filed by the Independent Pilots Association (IPA).


The IPA, which represents 2,600 UPS pilots, is challenging the FAA’s decision to exclude all-cargo carriers from the requirements of the new duty-time rule. The CAA's airline membership consists of ABX Air, Atlas Air, FedEx Express, UPS, Capital Cargo International, DHL Express, and Kalitta Air. The carriers association “has a strong interest in defending the rational, cost-benefit justified approach that the FAA adopted with regard to flight crew member duty and rest requirements for the all-cargo industry,” said the CAA motion to intervene. The IPA said it will not contest the motion.
