A lawsuit has been filed against officials of Texas’ Ector County and the county itself, demanding the cancellation of a recently awarded FBO lease at county-owned Odessa-Schlemeyer Airport and a redo of the RFP process, based on several perceived improprieties in the bid scoring. Wildcatter Aviation was selected at the end of an RFP process in July, its bid scoring higher than those of several other competitors, including the incumbent and Skypark Aviation.
Skypark president Ray Spengler filed a lawsuit alleging that the bid award was “based upon arbitrary, capricious and improper bidder evaluation scoring and/or in deliberate disregard for the weight of criteria as designated in the RFP,” as well as Texas law. He maintains that his company’s bid received several unreasonably low scores, while asserting that those of the winning company were likewise inflated. The lawsuit also claims that Skypark was not granted “fair and equal treatment with respect to any opportunity for discussion and revision of proposals.”
Citing the pending legal action, and the possible issuance of a temporary restraining order, County Judge Susan Redford, who heads Ector County’s administrative functions, declined to comment on the situation.
